Abstract

The constitution is the highest source in the national legal system and serves as the foundation for the formation of regulations, including business regulations. This study examines how the constitution underpins the protection of business actors' rights, the challenges in implementing such regulations, and ways to strengthen legal guarantees for business actors. The method used is normative with a qualitative approach through library research on legislation and academic literature. The objective is to analyze the constitution’s role as a legal foundation for protecting business actors in a systematic and comprehensive manner. The findings show that although constitutional guarantees are regulated, implementation faces obstacles such as regulatory disharmony and weak law enforcement. Therefore, improvements in legal structure and reinforcement of constitutional principles in every economic policy are necessary to create legal certainty and fairness for business actors.
